Commission files for appeal

Written By : SUN FIJI NEWSROOM. The Fiji Independent Commission Against Corruption (FICAC) has filed an application for leave to appeal a ruling delivered in the Suva Magistrates Court yesterday.
FICAC Prosecutor, Aca Rayawa, asked Magistrate Elsie Hudson to also put a stay order on the ruling that she had handed down to former Senior Hydrologist of the Suva Water Department, Faga Solomone Finiasi.
Ms Hudson granted the application made by the prosecution.
Finiasi was sentenced to 40 months imprisonment.
The remaining 16 months was converted into a $500 fine.
Ms Hudson ordered Finiasi three months to pay the fine.
If he could not pay the amount within the stated time, he could ask his lawyer to file an application for more time.
Ms Hudson said if the accused was to reoffend within the next 24 months, then the suspended sentence would no longer apply.
Ms Hudson said FICAC had 28 days to appeal the sentence.
In sentencing, Ms Hudson said the accused had abused his office by gaining benefit from his poorer subordinates.
She also highlighted that the Public Service overtime procedures stated that not everyone qualifies for overtime payments.
FICAC had charged Finiasi with 10 counts of official corruption that he pleaded to after the trial had concluded and said that he now wished to repay back the money. He obtained $380 from subordinates that worked under him in various projects between 2005 and 2006.
