Jailed For Aiding Murder

A man, who was convicted of aiding and helping in the killing of two youths at a hill in Tabia, Macuata, last year, was sentenced to nine years and six months imprisonment last Friday.

The court heard that Tevita Dutaboto and his accomplice, Nilesh Kumar, had picked up the two youths from Wailevu for a drinking party at Korosomo Hill.

During his judgement Justice Bandara said while they were drinking, Nilesh Chand smashed a bottle of beer on one of the youth’s head before doing the same on the other.

“After slicing victim one’s neck with a knife, Chand passed the knife to Dutaboto to repeat the same on victim two,” Justice Bandara said.

The judge said even though Dutaboto had refused slicing victim two’s neck he still offered to pin him to the ground.The court heard that Dutaboto had seized victim two’s hands while locking both his legs.

Justice Bandara said that while doing this Dutaboto had assisted Chand in decapitating victim two.

He said that victim two’s cause of death was a severed trachea, oesophagus and excessive blood loss.

Justice Bandara said the court also needed to consider the gravity of the offence before considering the minimum imprisonment term.

The court also heard the mitigation from Defence lawyer Penijamini Lomaloma, who told the court that Dutaboto had acted under duress after being shocked and traumatised on witnessing what Chand did on victim one.
