A summon to strike out the motion for a constitutional redress was made in the case between SODELPA’S suspended Member of Parliament Ratu Naiqama Lalabalavu, and Speaker to Parliament Dr Jiko Luveni.

The matter was heard yesterday in the High Court in Suva where Naiqama is challenging his two-year suspension from Parliament.

Naiqama was suspended on the grounds that he uttered a slur against the Speaker. Parliament had passed a motion to suspend Naiqama based on the recommendation of the Privileges Committee.

Queens Counsel Julian Moti, and Simione Valenitabua are representing Naiqama while Solicitor-General Sharvada Nand Sharma is representing the Speaker.

Mr Sharma applied for a strike-out of the motion citing that the High Court did not have the jurisdiction to hear the case on the constitutional redress.

Chief Justice Anthony Gates has directed both parties to file all necessary affidavits. He ordered that he would hear the constitutional redress and the strike out application together.

He asked for the affidavit in opposition of Naiqama’s constitutional redress while Ratu Naiqama has to file for a response to the strike out application.

The matter has been adjourned for a mention on September 29 to check on all documentations and set a hearing date on the matter.

Also present in court was the Leader of Opposition, Ro Teimumu Kepa.
