Shirley Park Rezoning Goes Ahead: Court

The rezoning of Shirley Park and the issuance of a special use tourism license for the Park will go ahead.

The Lautoka High Court has thrown out a case filed by the lawyer Aman Ravindra Singh on behalf of Maude Elbourne, Patrician Fraser, Chandra Lok, Denise Gibson and Mark Richmond, Orange Coast Investment Limited and Reddy Group Limited.

The case was filed seeking an injunction on rezoning works on Shirley Park.

While delivering his ruling on the matter, Judge Justice R S S Sapuvida noted the delays in hearing the case were a result of Mr Singh not filing the required documents in time.

Justice Sapuvida noted that Mr Singh and the plaintiffs were “evidently out of time by more than 60 days to bring the instant application for redress.”

He said that the plaintiffs were “patently guilty for the undue delay caused for not bringing their application within the mandatory period of 60 days from the date of the cause of action which cannot be cured later and inevitably warrants a certain dismissal”.

The court ordered that the notice of motion filed was to be struck out and dismissed, and also that the plaintiffs pay the defendants- who in this case were the Local Government Minister, Director of Town and Country Planning and Lautoka City Council, costs of $750.
