A 28-year old man was sentenced to 12 years and 11 months imprisonment for the rape of a child below the age of 13 years.

The incident, involving a four-year-old victim, happened last year.

The court heard that the accused called the victim in his room and inserted his fingers in her private part. The girl then informed her mother who reported the matter to Police.

In sentencing the accused, High Court judge Justice Salesi Temo said rape of children was becoming prevalent in Fiji and the courts needed to impose a sentence that would deter future offenders from committing similar offences.

Justice Temo said the accused, who was related to the victim, abused her trust in him as her protector.

The accused admitted a previous conviction for two counts of similar offences in 2010.

He was sentenced to 40 months imprisonment by the Suva Magistrates Court for the two counts of indecent assault with a non-parole period of 34 months. The latest offence was committed while the accused was out on bail.

Justice Temo did not find any reason to let the sentence run concurrently as he said it was the court’s duty to protect children from sexual exploitation.

Justice Temo ordered that the sentence be run consecutively on the uncompleted sentence out of the 40 months imposed by the magistrates court. He will be eligible for parole after serving eleven years imprisonment.

A permanent domestic violence restraining order has also been set to protect the victim.
