Taveuni Man Acquited Of Rape

A man charged with raping a woman in Taveuni on September 25, 2014 was acquitted by the High Court in Labasa last Friday.

Justice Paul Madigan acquitted and discharged Seruvatu Sauvuni Ratuva following a unanimous guilty opinion by the three assessors.

The woman had accused Ratuva of rape, but did not report the matter until she discovered she was 29 weeks pregnant.

In summing up Justice Madigan said the court was troubled by the late report of rape and that both were seen having dinner at the accused’s home and talking and laughing.

“I am aware that the lateness of the report does not necessarily detract from the allegation of sexual assault, but in this instance, when a contemporaneous is made to the family because of her stated feelings of guilt, there is reasonable doubt raised in the prosecution case,” Justice Madigan said.
