Man Found Guilty Of Attempted Rape And Murder
A 29-year-old man has been found guilty for a count each of attempted rape and murder by Suva Judge Justice Salesi Temo.
Justice Temo will deliver his written reasons and the sentence today.
On July 15, 2013, Vinend Kumar attempted to rape the victim and on the same day he murdered her.
Justice Temo while delivering his sum up said: “You cannot cut open the accused’s head to find out what his intensions were at the material time.”
The defence had argued throughout the case that Kumar, at the material time, did not intend to kill the victim, but only wanted to cause her harm and therefore he is guilty of manslaughter.
The deceased was a 53-year-old woman suffering from a sickness for which she had approached Kumar, to make a medicine for her, as he was known as an herbalist.
The argument between the two arose on July 15, 2013, when the victim asked Kumar where her gold chain was and was told that he had sold it.
The prosecution maintains that the accused got excited and tried to rape the deceased.
According to the medical report the deceased suffered extensive injuries to her face and head.
