Defence lawyer had requested for an early trial date because this matter has been pending in court for the past five years.

 

Suva Magistrate Shageeth Somaratne will decide on whether to continue a case of an alleged spreading of seditious comments in public in 2011 against businessman, Jagath Karunaratne, and Member of Parliament Mosese Bulitavu, or start again from the beginning.

Magistrate Somaratne took over the case after Chief Magistrate Usaia Ratuvuli recused himself from the case on November 21 because of a conflict of interest.

Karunaratne and Bulitavu who are charged with spreading seditious comments in public have been given a trial date set from May 15 to 19, 2017. They deny the charges.

Magistrate Somaratne will decide on February 3 whether a fresh trial would be ordered or will the trial continue before him from where it was left off at the Chief Magistrates Court.

Defence lawyers Aman Ravindra Singh and Barbara Malimali have requested that the case continue from where it had stopped.

Mr Singh requested the court to decide on one of the two options before the court.

Magistrate Somaratne has informed the defence lawyers that he would make a decision after looking at the court records which were currently being typed for him.

Mr Singh had requested for an early trial date because this matter has been pending in court for the past five years.
