40-year-old found guilty of infanticide

A 40-year-old mother who was charged for murder has been found guilty for the lesser offence of infanticide by Suva High Court judge Justice Riyaaz Hamza.

According to the evidence produced during trial the court heard that on July 18, 2011; Vika Kelekele Laliqavoka who was pregnant gave birth to a baby boy in the bathroom of her house.

Justice Hamza overruled the verdict of the assessors who declared Laliqavoka guilty of murder.

In making his ruling Justice Hamza said the court heard that she had gone to the bathroom to have her shower when she felt like someone had poked her with a needle on her lower back.

She stood in a standing position till she felt something fall off, he said.

Laliqavoka had told the court that it was her baby that had fallen and she had then tried to sit down and then later had a blackout, he said.

He said upon regaining consciousness she looked at her new born baby lying face downwards.

She then held her baby who wasn’t moving nor breathing, he said.

He said the court heard she said that she tried to open the baby’s mouth by pressing his nose however the baby didn’t respond.

Justice Hamza said he found Laliqavoka guilty of infanticide.

The case has been adjourned to July 14, for sentencing submissions.
