Judge Finds Brother Guilty Of Manslaughter

Manslaughter accused, Aisake Vana Junior, who killed his brother over a bowl of dhal was found guilty of manslaughter yesterday.

He will be sentenced today.

Judge Justice Vincent Perera delivered his judgment yesterday at the High Court in Suva.

Charge

It is alleged that Junior, 39, on April 5, 2016 at Nasinu had an argument with his younger brother Suliasi Veisere over a bowl of dhal.

The younger brother allegedly threw a punch at the accused before he was allegedly stabbed in retaliation.

Judgment

Justice Perera said that Vana Junior had deliberately stabbed his brother with a knife.

“Junior intended to cause serious harm to the deceased and he did not give a true account of what had happened.

“There were inconsistencies with the evidence given by Junior compared to what is in the caution interview.”

It was further stated by Justice Perera that there was no dispute, that there was a physical altercation and that the prosecution had alleged that Junior deliberately stabbed the deceased due to the way he reacted over a bowl of dhal.

Justice Perera accepted the evidence given by the prosecution witnesses and he found it credible.

He further stated that considering Junior’s demeanor, he did not give a true account of what had happened on the day of the incident despite being remorseful.

On Wednesday, two assessors of the three found the accused not guilty of the charge.
