The High Court in Lautoka on Friday sentenced a security guard to 12 years and seven and a half months for raping an 11-year-old girl in 2012, with a non parole period of nine years.

While sentencing the 27-year-old, Judge Justice Sunil Sharma said the victim would not forget what was done to her because instead of protecting her as a cousin, he had scarred her for life.

The court heard that between December 1 and December 31, 2012; the victim was residing with her parents and two older brothers in Rakiraki when the accused, a distant cousin, came to the house with two of his friends. Along with the victim’s brothers, they went to a nearby river to swim, but he made his way back to the house where the victim was alone, and raped her.

He only left after the victim, who was in pain, asked him to do so. The matter was only brought to light when the accused was caught putting his hand on the victim’s buttocks which was spotted by her aunt who was told about what had happened, the court heard.

In mitigation, the accused said he was a security guard in Vatukoula and was a first offender. He said he had apologised to the family and was expecting his first child from a de-facto relationship.

Justice Sharma said the aggravating factors were that the accused had committed the offence in the victim’s house and had breached the trust of a helpless and vulnerable victim. He said the victim was 11 years of age and there was a nine year gap between the two.

“You had committed a serious offence against a victim who trusted you and was related to you. No amount of remorse or regret will bring back what the victim had lost. The court has an obligation to protect the vulnerable from any form of sexual abuse and an immediate long term custodial sentence is warranted,” ” Justice Sharma told the accused.
