A man who was found guilty of raping and attempting to commit rape of an 11-year-old girl will be sentenced at the High Court in Suva today.

Yesterday, Judge Justice Thushara Rajasinghe told the court that, satisfied with the evidence of the prosecution he found the accused guilty of both counts.

Previously, two assessors had found the accused guilty of both counts.

One assessor had found the accused not guilty of rape but guilty of attempting to commit rape.

The accused had admitted in his evidence that he had sexually assaulted the victim. However, he refused to admit that he had raped her.

The defense counsel had disputed that the accused had not penetrated the victim.

However, Justice Rajasinghe said any form of slightest penetration was considered rape.

He said the victim had revealed in court and her mother what had happened to her.

While there were inconsistencies in the evidence of the victim, Justice Rajasinghe said she was an 11-year-old and could not be expected to remember everything.

But she answered questions in court without evading them, he said.

Both counsels were given time until yesterday afternoon to file their sentencing submissions.

The accused had been in remand since the incident took place last year.
