Judge Sums up Today on Man  Accused of Raping Wife

Judge Justice Riyaaz Hamza will deliver his summing up in the case of a man charged with the rape of his ex-wife.

The accused, 33, is charged with four counts of rape. The crime was allegedly committed while they were married.

They are now divorced.

He is alleged to have raped his ex-wife with an eggplant.

The alleged incident occurred between November 30, 2015 and January 5, 2016.

During cross-examination state lawyer Shirley Tivao asked the accused if he got angry about her affairs to which he said yes.

Ms Tivao questioned the accused on why he breached the domestic violence restraining order (DVRO).

The accused said that he had said to his ex-wife that her God will call her soon because she had chased her own mother from the house.

The accused had also admitted in court that he had slapped his ex-wife once in 2013 when she had attacked him with a cane knife.

Ms Tivao said the accused was angry at his ex-wife for sending him to prison for the DVRO breach. But the accused disagreed and told the court that things between him and his wife were good.

He told the court that he had never threatened her. He said every time his ex-wife complained to the Police that he had breached the DVRO, Police would not listen to him and would lock him up in the cell.

During re-examination by the defence lawyer Talei Kean the accused told the court that the reason he didn’t leave his ex-wife was because he didn’t want to lose his marriage as he loved his ex-wife and he didn’t want to lose his daughter.

The accused said he had pleaded guilty to the second DVRO case because he had been remanded for 21 days and he assumed that if he pleaded guilty the magistrate would give him a suspended sentence which did not happen.
