The Maritime Safety Authority of Fiji (MSAF) represented Fiji at an interactive workshop on General Principles of Drafting National Legislation to Implement International Maritime Organisation (IMO) Conventions.

The workshop was held from September 18 to 22, 2017, at the IMO Head Quarters in London and funded by the IMO International Technical Co-operation Programme.

“This was an opportunity for legislative drafters to understand the structure and processes of IMO and better equip them to draft and implement Maritime Legislations nationally,” said MSAF chief executive officer, John Tunidau.

Participants from 22 countries were present at the five-day Workshop and trained on drafting of national legislations correctly while ensuring they reflect the provisions of IMO treaties that each member state has ratified or acceded to.

The workshop was attended by Mr Tunidau and some of the topics covered included:

  Understanding the IMO, how it works and its Structure;

  Understanding the IMO Treaty-making and regulatory process;

 Understanding the Maritime Transport Policy required for each member  State;

   Understanding the Legal framework upon which IMO Conventions are built – prevention, mitigation and compensation;

   Ways of implementing IMO instruments with respect to flag, port and coastal state obligations and responsibilities of each IMO member State;

   Understanding the law-making process and implementation of Conventions in the national legislation of participating countries;

  Legislative drafting to implement IMO Conventions with respect to legislative drafting principles and techniques: enforcement – compliance, monitoring, sanctions; and

  Understanding IMO Conventions, in terms of what the legislative drafter needs to know, including practical exercises.
