Teen Jailed For 107 Months For Drugs Cultivation

An 18-year-old was sentenced to eight years and 11months imprisonment after he was found guilty of cultivating 824 plants of cannabis sativa (marijuana) ranging from 12cm to 129cm.

Atikini Matakorovatu was charged with unlawful possession and cultivation of illicit drugs after he was caught during operation Cavuraka 2 in Kadavu.

On September 15 last year Atikini was found in possession of 1184.4grams of loose cannabis sativa plants and was found to have cultivated 7975.7grams of cannabis sativa.

“Cultivation up to 10 plants can be considered as non-commercial cultivation if there is no other evidence to the contrary,” Suva High Court Judge Justice Vincent Perera said.

“Cultivating more than 10 plants up to 100 plants can be considered as a small scale commercial cultivation and cultivating more than 100 plants can be considered as a large scale commercial cultivation.”

Justice Perera took into account the large quantity that was cultivated, adding that the sentence should be within 7 to 14 years imprisonment.

In mitigation Defence counsel submitted that the accused was a first offender and had cooperated with Police.

He had pleaded guilty for the two offences on the first day and was remorseful.

He also sought the court’s forgiveness.

Atikini was ordered to serve six years and 11months of his sentence before he can apply for parole.
