A 22-year-old Suva man was ad­vised by the Court to reflect on his life and where he was head­ing if he continued to commit crimes.

Suva Magistrate Waleen George made the comments after giving Sailosi Lako­vi Seniceva a six-month prison term and suspended it for two years for charges of theft and resisting arrest.

The facts of the case revealed that on July 15 this year at about 1am the com­plainant was with some of his friends at Signal Nightclub.

While he was on the dance floor Senice­va collided with him and immediately the complainant felt his black Alcatel phone removed from his side pocket.

The complainant then followed Sen­iceva around and later walked outside where he saw Seniceva passing his phone to an accomplice.

The complainant tried to grab his phone but the two men fled with the phone.

With assistance from bystanders and two Police officers Seniceva was ar­rested and escorted to the Totogo Police Station.

Whilst being escorted he tried to resist arrest in an attempt to escape from the custody of the two officers.

Magistrate George accepted Seniceva’s plea saying it was unequivocal in that it indicated that he understood the reper­cussions of his plea.

Magistrate George said the starting point of Seniceva’s sentence would de­pend on the gravity of the offending.

The Court noted that the only aggravat­ing factor in the case was that the phone was not recovered and the accused acted in a disorderly manner whilst being es­corted to the Police station.

“You are also a young offender. I will provide you with another opportunity to reform,” Magistrate George said.

Seniceva was given 28 days to appeal his sentence and/or conviction.
