A 23-year-old man convicted for burglary and theft was given a second chance by the Suva Magistrates Court yesterday.

Accused, Alipate Koliloa, was told by the sentencing magistrate that a non-custodial sentence was warranted to allow him to rehabilitate himself.

Koliloa was sentenced to two months imprisonment, suspended for two years for one count each of burglary and theft.

In passing sentence, Magistrate Asanga Bodaragama said the accused had pleaded guilty to the offence and admitted to the summary of facts.


Facts of the case

Between March 17 and 18, 2016, Koliloa broke into the complainant’s house through the front door at the Fiji Meteorological Service  quarters in Vatuwaqa.

After entering the house, Koliloa stole a 32-inch Panasonic Television valued at $900 and a Kawasaki brush cutter valued at $1900.

Magistrate Bodaragama said Koliloa’s mitigation submissions had been taken into consideration and his history.

He also passed a two months suspended sentence for Koliloa who also pleaded guilty to one count of absconding bail.

Koliloa was charged with the offence after he was released on bail on December 19, 2016 and failed to appear in court on March 6, 2017.

Koliloa was ordered not to reoffend within the next two years, in default two months imprisonment.

He was given 28 days to appeal.
