Duruimata Pleads Guilty To Manslaughter, Awaits Sentence

A man jointly charged for the death of another man following a nightclub brawl on July 5, 2016 has pleaded guilty to the offence.

The accused, Bai Duruimata, will be sentenced in the Suva High Court on April 20, 2018.

Duruimata was charged alongside co-accused Sanaila Noke who maintained a not guilty plea to manslaughter.

It is alleged that they punched and stomped on the deceased at Whistling Duck Nightclub in Nausori resulting in the deceased receiving severe head injuries and causing his death.

Defence lawyer Lisiate Qetaki questioned prosecution witness Jone Leweni yesterday if he saw Duruimata punch the deceased on the chin.

Mr Leweni told the court that he saw Noke punch the accused and not Duruimata.

Justice Salesi Temo questioned the witness if he was taken for a Police identification parade to identify the accused.

The witness responded that he was never taken for a Police identification parade, adding that the first time that he identified Noke since the day of the alleged incident was in court yesterday.

Justice Temo then asked him how he could recognise the accused since the lights inside the nightclub were yellow and the accused was of dark complexion.

He said seeing Noke reminded him of the alleged incident.

Furthermore, Justice Temo asked the witness how it was possible that he claimed to have seen Noke punch the deceased on the chin which made him unconscious, after the first accused Duruimata had pleaded guilty and admitted to punching the deceased.

Mr Leweni said he was sure that Noke had punched the deceased on the chin.

Trial continues in the High Court today.

Noke is currently remanded in custody while Duruimata is also remanded pending sentencing.
