A 27-year-old man who was convicted for raping his ex-wife was sentenced to six years, seven months and 20 days imprisonment on Friday.

On May 6, 2015, the accused allegedly raped and sexually assaulted the complainant in her home.

The accused visited the complainant’s home around midnight while she was alone with their daughters.

When she went to the bedroom to put their daughters to sleep, the accused entered the bedroom despite protests from the complainant.

While she was putting their daughters to sleep, the accused started touching her.

He then pushed her and told her to lie down on the bed. When she fell on the bed, he started pulling her nightie up and pulled down her undergarment.

Then he dragged her to the kitchen, pushed her down to the mattress and started kissing her tummy and ordered her to perform a sexual act on him. Then he proceeded to have sex with her without her consent.

He threatened the complainant and told her not to go and report to the Police, adding that if she went to the Police, he would take out one of her eyes and kill her.

Justice Aruna Aluthge said rape was prevalent in Fiji and offenders must be punished to denounce and to send a clear message to the community that such actions would not be tolerated by the courts.

He said the accused chose to satisfy his lustful demands without having any regard for his children who were sleeping on the same bed at the material time.

The accused will serve six years of his sentence before he is eligible for parole.
