4 men sentenced for Nakasi service station murder

Four men charged with the death of a 21-year-old man in Nakasi in February 2016 were sentenced in the High Court in Suva yesterday.

The accused men: Alipate Naimoso, was charged with assault causing actual bodily harm; Saimone Tucila Senior, 55, Epeli Tucila, 29, and Saimone Tucila Junior, 23, were charged with murder.

Naimoso was working at a Service Station in Nakasi as an attendant on the night of the incident when the deceased confronted him and an argument erupted between the two.

The court heard Naimoso threw several punches on the deceased which was captured on Closed-Circuit television (CCTV).

The two men fought each other and Naimoso’s three co-accused joined and assaulted the deceased.

The three trial assessors found the three murder accused not guilty for murder however they found them guilty for manslaughter.

Naimoso was found guilty for assault and convicted accordingly.

While delivering the sentence yesterday, Justice Riyaz Hamza said the aggravating factors were that the accused persons had taken away the life of another.

He said the men overpowered the deceased and used extreme force on him.

Naimoso was sentenced to one year imprisonment and suspended for three years while Saimoni Senior was sentenced to seven years and nine months imprisonment with a non-parole period of four years and nine months.

Epeli and Saimone Junior were sentenced to five years and nine months imprisonment with a non-parole period of three years and nine months.
