Two men charged with aggravated burglary and theft were discharged by the High Court in Suva yesterday.

On April 14, 2018, the duo Mesake Navatoga, 20, and Semi Rakai, 20, allegedly unlawfully entered the victim’s home in Toorak and stole cash amounting to $3250 and assorted jewellery valued at $33,742.

They appeared before Justice Daniel Goundar and were represented by Legal Aid lawyer Litiana Ratidara.

State lawyer Sujata Lodhia made an application for a nolle prosequi for both accused and informed Justice Goundar that the State faced issues in relation to the identification of the two accused men.

Ms Lodhia said none of the stolen items were recovered.

She said Navatoga had a previous conviction for theft.

Ms Ratidara told the court that Rakai had no pending matters.

Accordingly Justice Goundar accepted the State’s application and discharged the two men from proceedings.
