Victim Recalls Day of Alleged Rape Horror

The victim of an alleged rape told the High Court in Suva yesterday that the accused held her head and pushed it towards his private part to perform a sexual act.

However, she then testified that the accused, Napolioni Leiloma, did not forcefully open her mouth, punch her, swear at her, strangle her or tie her up before allegedly raping her.

The alleged incident happened on October 9, 2016 in Waimaro, Tailevu, where two young women aged 19 and 20 years old respectively were allegedly raped by four men.

Leiloma is being tried before Justice Salesi Temo with co-accused Wame Baleimakogai, Luke Sorovakatini and Sanjay Lal.

They are charged with four counts of rape and one count of assault with intent to commit rape.

During cross examination by Leiloma’s lawyer Lavinia David, the victim said on the day of the alleged rape at about 9pm she walked to Nausori Town from Vunimono with her friend to go and look for money.

In town Sorovakatini approached her and told them to join him and his friends for a cruise to Nausori,  which the two girls agreed.

She got inside the car with her friend and sat in the back seat with Sorovakatini and Leiloma, Baleimakogai sat in the passenger seat in front while Lal drove the car.

The victim said they told them that they would go to Waidalice.

She disagreed with Ms David that she sat on Leiloma’s lap during the car ride to Korovou Town.

The victim testified that they were drinking liquor inside the car and talking with the four men.

Ms David put to the victim that while the car was moving and she was sitting on Leiloma’s lap, she was pushing her buttocks on his groin area.

The victim said no and denied sitting on Leiloma’s lap.

She also denied asking him if he was married and that he told her that he was interested in her.

She also said she did not kiss the accused inside the car and did not touch him.

She said when they stopped beside the Korovou Police Station she did not get off.

From Korovou Town the witness said they drove for about 30 minutes before they got to a secluded spot.

She said the four men got off the car and Leiloma pulled her friend from the back seat and Lal punched her on the mouth.

Leiloma then entered the car from the victim’s side and took her to the back of the car where he allegedly undressed and forced her to perform oral sexual acts on him.

She said she was scared, but she did not scream. The trial continues in the High Court today.

Three of the four men are on bail while Sorovakatini is a serving prisoner.

On the first count of rape, Baleimakogai, Leiloma and Sorovakatini are alleged to have had carnal knowledge of the complainant without consent on October 9, 2016 in Waimaro, Tailevu.

On the second count, Leiloma allegedly performed a sexual act on her without her consent.

For the third count, Baleimakogai allegedly performed a sexual act on her without her consent.

On the fourth count, Baleimakogai, Leiloma and Lal allegedly had carnal knowledge of the complainant without her consent.

On the fifth count, Lal allegedly punched the complainant’s mouth with the intention to commit rape.
