A man charged with raping his 40-year-old de facto partner has had an interim domestic violence restraining order issued against him by the High Court in Suva.

The 35-year-old man appeared before Justice Daniel Goundar, who imposed standard no contact and non-molestation orders.

It is alleged that on April 20, 2018, the accused raped his de facto partner at Omkar Road in Narere.

Defence lawyer Abhay Singh indicated that he wanted to make an oral bail application on the accused’s behalf, but was told that the High Court did not entertain such applications. Justice Goundar said the case involved a domestic violence offence, which was a serious allegation of rape.

He said the sureties needed to be examined in open court and had to be of authority over the accused and have good standing in the community. The matter was for first call in the High Court and State lawyer Shirley Tivao asked for 21 days to file information and disclosures.

Justice Goundar remanded the accused pending his formal bail application. The case has been adjourned to July 23, 2018, for mention.
