A 24-year-old man was sentenced by the High Court in Suva to one-and-a-half months in jail suspended for three years.

Timoci Motokula Ratubalavu appeared before Justice Chamath Morais on Friday after which he was sentenced for one count of assault causing actual bodily harm.

On May 19, 2018, at 4.30am in Nasinu, Ratubalavu assaulted a 30-year-old by punching her on her forehead causing her actual bodily harm while she was in a group waiting for a cab after a drinking party.

As a result, the complainant sustained injuries.

The aggravating factors for Ratubalavu was that the offence had taken place in a public area, it was an unprovoked attack on a female by a male, Ratubalavu did not show any regard for the complainant’s rights and personal safety and the seriousness of the injuries.

The mitigation factors the court observed were that the injuries were not of a permanent nature, Ratubalavu had sought forgiveness from the court, had assured that he would not reoffend and had co-operated with Police.

Justice Morais told the court that Ratubalavu was a first offender and had no previous convictions or pending cases, therefore the chances for rehabilitation were high.

Justice Morais suspended Ratubalavu’s sentence for three years and advised him of the effect of breaching a suspended sentence.

Ratubalavu was given 30 days to appeal to the Court of Appeal.
