A Media Watch Group statement has been labelled as incorrect in law by the Supervisor of Elections Mohammed Saneem.

In a statement Media Watch said that the date for the 2018 General Election was November 26.

Mr Saneem said it was an incorrect statement published by the group.

“We have perused the statement and found that those who made the statement failed to consider various provisions in the Constitution, which would allow them to make a correct decision on the legal position regarding the election date,” the Supervisor of Elections said.

“The Constitution is very clear. Following the conclusion of three years and six months of Parliament, the Prime Minister may advise the President at any time to dissolve Parliament and issue the Writ for the Election.

“This does not mean that the Parliament would have to convene and vote for a majority for the Parliament to be dissolved, but it’s directly on the advice of the Prime Minister to the President,” Mr Saneem said.

He said as the election management body, they urged caution to all organisations such as the Media Watch Group and any other organisation that may be formed for the purposes of advocating the 2018 General Election to be cautious about the accuracy of information in publications they produce.

Particularly, when it is being disseminated across all mediums because it will only create confusion.

“The Fijian Elections Office has already published numerous materials that can be relied on to get the most accurate information in relation to the election,” Mr Saneem said.

“And these groups are invited to first read through our materials so that they know from the election management body directly what the legal position is.

“In the event they have any queries, they may contact us for clarification.

“We would like to categorically state that the Media Watch Group statement as issued on 31st July is incorrect in law.

“The fact that it has been disseminated without proper vetting in terms of the legal side of things makes it quite careless and I may say even irresponsible,” Mr Saneem added.
