Prominent Bau chief Ratu Epenisa Cakobau is seeking orders in the Suva Magistrates Court against a Police officer and a soldier with the Republic of Fiji Military Forces.

Ratu Epenisa and his son Ratu Popi Cakobau, as applicants, appeared before Magistrate Jioji Boseiwaqa yesterday seeking to obtain orders on August 3, 2018 for standard non-molestation and non-contact orders under Sections 27 and 29 of the Domestic Violence Act 2009.

The basis of the application was that at 6am on June 8, 2018 two officers allegedly entered his bedroom armed with guns and allegedly kidnapped him at gun point.

Ratu Epenisa alleges that the officers did not have a search warrant, adding that they harassed, threatened assault with violence and behaved in an abusive manner towards him.

Magistrate Boseiwaqa asked the parties in court if they had any objections with him hearing the case because he was previously linked with the military as a lawyer.

Lawyers for the two officers raised no objections including Ratu Epenisa and his son Ratu Popi.

Lawyers representing the military officer made an application for the matter to be struck out before a hearing date was fixed on the ground that there was no domestic relationship between the RFMF officer and Ratu Epenisa and his son.

The Police officer’s lawyer made a similar application in court and said his client denied any relation to the chiefly family.

He was merely carrying out his duty as a Police officer under the instructions of the Commissioner of Police.

Ratu Epenisa submitted in person that they were basing their application for a restraining order on the ground that they were related to the respondents through traditional kinship ties, adding that the Police officer was his nephew.

The case has been adjourned to September 10, 2018, for Magistrate Boseiwaqa to deliver his ruling on the matter.
