Three Accused Get Suspended Sentences From High Court

Three men walked out of the High Court in Suva with smiles when they were given suspended sentences yesterday.

Sisa Biusavu, 21, Ratu Peni Ravisa, 20, and Mika Tabanavou, 18, appeared before judge Justice Daniel Goundar for their sentencing.

Justice Goundar read the sentence on behalf of Justice Vincent Perera.

Biusavu, Ravisa and Tabanavou were each charged with one count each of aggravated burglary and theft.

For the count of aggravated burglary, on May 6, 2018, in Navua, the three accused entered a store with the intent to commit theft.

For the count of theft, on May 6, 2018, they stole $1550.75 from a store in Navua.

In the mitigating factor, it was highlighted that the stolen amount was returned before a report was lodged with Police.

Justice Goundar also noted that the three accused were first offenders and took their ages into consideration.

He imposed a jail term of two years eight months suspended for three years.

Justice Goundar ordered that there be a non-parole period of 20 months and further directed that the accused each serve four months behind bars.

However, taking into account the fact that the three had been in remand for four months Justice Goundar ordered that they be released.

Justice Goundar told the three accused that if they reoffended while on the suspended sentence, they could be charged with breach of the suspended sentence and the sentence would be activated.
