11 Year Jail Term For School Teacher

High Court Judge Justice Aruna Aluthge says the courts will come down harshly on teachers abusing students and committing sex offences.

He made the statement while sentencing a 42-year-old former teacher to 11 years imprisonment with a non-parole period of eight years.

The man, who recently had a surgery, was lifted on a chair by Police escorting officers and taken to the courtroom for his sentencing yesterday afternoon.

The court heard that the man was not able to walk or stand because of surgery.

The man was initially charged with 10 counts of rape, however, the counts were consolidated and went in trial with two representative counts of rape.

The offences occurred between February 12 and 13, 2016, in Suva.

The victim in the matter was a Year 13 student where the accused was teaching as a secondary school teacher.

The court heard that the man was married with two children and his wife was also a teacher at the same school.

The three assessors had given a unanimous verdict of not guilty, however, Justice Aluthge had overturned the verdict and found Kumar guilty of rape.

Justice Aluthge said to the man that he knew the victim had not consented to the acts and was a minor when he had first met her as her teacher.

“You forced the victim to engage in a relationship with you. You punished her when she did not listen to you and used the sex video against her by blackmailing her.

“You groomed her to be your sexual pleasure. You betrayed your wife and also the victim.

“You knew she was in the fear of being exposed on social media and because of the offence, she had to discontinue with her education and go back to Labasa.

“The court needs to protect the society from careless and offenders such as you,” Justice Aluthge said.

The man was given 30 days to appeal to the Fiji Court of Appeal
