Koroitamana Has Murder Charge Reduced To Manslaughter

A man who was sentenced to seven years imprisonment for murder has had his charges amended to manslaughter. As a result, his sentence has been reduced to five years.

The appellant, Kameli Bola Koroitamana, appeared before the Court of Appeal Justices Eric Basnayake, Justice Farzana Jameel and Justice Priyantha Nawana last week.

The judgment comes into effect from October 4, 2019.

Mr Koroitamana appealed against his sentencing on the grounds that:

  • That the learned judge erred in law and fact when he took into account irrelevant factors to aggravate the offence,
  • The learned judge erred in law and fact when he did not consider the appellant’s remorse as a mitigating factor,
  • That the sentence of seven years imprisonment with a non-parole period of six years imprisonment was manifestly harsh and excessive considering the entire circumstances of the case.

In 2018, the Court of Appeal granted leave encompassing grounds two and three, that is, whether the sentence was harsh and excessive and whether the learned judge considered the conduct of remorse.

The Court of Appeal has the power to quash a sentence passed and to replace it with a different sentence or dismiss the appeal.
