The defence lawyer in the Nasinu Pastor’s rape case told the court that he was ready to proceed with the trial next year in March.

Waisake Tulavu will have his trial heard at the High Court in Suva from March 2 to March 15, 2020.

Tulavu appeared before Judge Justice Daniel Goundar yesterday.

He is facing four counts of rape and one count of sexual assault.

Defence lawyer Jerry Dinati told the court that he was confirmed as the new defence counsel on record for the matter and was ready to proceed with the trial next year.

He also told the court that he had received the full phase of Disclosures from the accused and sought time to confirm on the proposed agreed facts and other issues, if any, after he has spoken with his client.

State prosecutor from the Office of the Director of Public Prosecutions, Lavenia Bogitini told the court that the State would be calling 10 witnesses for the trial, including three complainants, two Police officers, two eye witnesses and the reverend of the church who was in charge of Tulavu at the time when the alleged offences took place.

She told the court that the State was not relying on the caution interview statement and that the State was ready to proceed with the trial.

The matter was adjourned for the pre-trial conference on February 21, 2020.

Tulavu was further remanded in custody.

The charges:

On the first count of rape, on May 11, 2018, in Nasinu, Tulavu allegedly raped a 22-year-old woman.

On the second count of rape, it is alleged that on the same day, Tulavu again performed a sexual act on the 22-year-old complainant without her consent.

On the third count of rape, on the same day, Tulavu allegedly performed a sexual act on the 22-year- old complainant without her consent – for the third time.

In the fourth count of rape, it is alleged that Tulavu on June 16, 2018, in Nasinu, Tulavu allegedly raped a 29-year-old woman.

For the charge of sexual assault, it is alleged that Tulavu on September 15, 2018, in Nasinu, unlawfully and indecently assaulted a 32-year-old woman.
