Village Headman Jailed For Sexually Assaulting Minor

Being the village headman, you were supposed to protect the people in your village. But you failed that role miserably when you sexually assaulted this juvenile whilst the others were watching.

These were the comments made by Magistrate Shageeth Somaratne while sentencing a 54-year-old village headman to six years and 11 months imprisonments for the offence of sexual assault.

A non-parole period of five years was set. The headman was charged and convicted for one count of sexual assault.

The victim was 15-years-old at the time of the offence.

On November 24, 2015, the victim was returning from the river when he met the headman.

The accused asked the victim to pull his trousers down and assaulted him with a stick.

Magistrate Somaratne said the man was the victim’s cousin and by committing the crime, he breached the trust of the victim.

The court heard that the victim was injured from the assault.

Magistrate Somaratne said the maximum penalty for the sexual assault under the Crimes Act was 10 years imprisonment and the tariff was two to eight years imprisonments.

“…This is to be expected as the offence you committed is more of an aggravated sexual assault.

“Even though you want to traditionally reconcile with the victim, this is an offence that can’t be reconciled under the law and I would disregard that also.

“Being the village headman you were supposed to protect the people in your village. But you failed that role miserably when you sexually assaulted this juvenile whilst the others were watching.

“You also grossly breached the trust when you committed this on your own young cousin.

“Hence you have to serve this long custodial sentence to denounce your behaviour and to punish you for this heinous crime,” Magistrate Somaratne told the village head man.

A permanent domestic violence restraining order was also imposed.
