56-Year-Old Man Jailed 12 Years for Raping Niece

When children are sexually abused, the harm to their mental health is significant.

Judge Justice Daniel Goundar made the comment while sentencing a 56-year-old man to 12 years imprisonment for rape and indecent assault charges.

The offender had pleaded guilty to a representative charge of indecent assault and one count of digital rape.

The victim is a nine-year-old niece of the offender and a primary school student.

The victim was sexually abused over a period of one year by the offender in her home in 2019 in Suva.

The offender then gave the victim $2 to keep her quiet from complaining.

The victim’s mother got suspicious when she saw the offender’s hand on the victim’s thighs.

She took the victim to their bedroom where the victim relayed to her that the offender had been abusing her.

Justice Goundar said the victim was vulnerable due to her gender and young age.

He said the victim’s trust was breached and was abused by a family member in her home.

In the victim impact statement, the victim stated that she was frightened of the offender and that she was now frightened of older men in her family because of what the offender did to her.

Justice Goundar reiterated that rape was punishable by life imprisonment and indecent assault was punishable by five years imprisonment.

He said the sentence of the offender must reflect the principles of denunciation and deterrence because sexual abuse of children were too prevalent in our community.

The offender was convicted and jailed for two years for indecent assault and 12 years for rape, to be served concurrently with a non-parole period of 10 years.

Justice Goundar also ordered that the offender shall be subjected to a domestic violence restraining order with no contact and non-molestation conditions for the rest of his life.
