Defence Counsel Questions Prosecution On Time Usage

How long will it take to file the information, what is the problem?

These were the arguments by defence lawyer, Iqbal Khan, at the High Court in Lautoka on Tuesday when questioning the prosecution in a murder case. The case involving accused persons, Ajay Kumar and his son, Ashneel Kumar was called before High Court Judge, Justice Sunil Sharma.

Both are facing one count of murder each.

It is alleged that the duo murdered Saleshni Devi on September 15, after she was found metres away from a vehicle that had gone down a cliff.

Her body was first discovered the following day by Matawalu Village couple, Sanaila Bula and Lusi Marakiwai.

State lawyer, Unal Lal said the information regarding the matter was not ready but the State had filed the first phase of the disclosures and was ready to serve it.

Mr Lal sought 14 days to file the information.

Mr Khan told the court that in the interest of justice, it was not fair that the prosecution had sought more time to file the information as his clients remain in remand.

He also questioned when the second phase of the disclosures would be served.

He made a request for the court to give the State seven days.

In response, Mr Lal said he understood where Mr Khan was coming from, but he still needed 14 days to file the information.

The matter has been adjourned to December 21 for mention.
