Suspended Doctor On Sex Assault Charge Back In Court

Dr Joji Vakadiwaiwai, a suspended Senior Medical Officer of the Colonial War Memorial Hospital (CWMH) appeared at the Magistrates Court in Suva facing charges of sexual assault.

The 36-year-old appeared in custody before Magistrate Indula Ratnayake.

Charged with two counts of sexual assault, the accused is alleged to have procured the complainant who was a medical intern at the CWMH, unlawfully and indecently assaulted the complainant by touching her and attempting to open the zip of her pants.

The alleged incident took place between May 1, 2020, and June 30, 2020, at the CWM Hospital.

It is also alleged that Vakadiwaiwai, without the complainant’s consent, committed gross indecency by exposing his private parts.

 

Bail

Police Prosecutor Sitiveni Baleitaveuni objected to bail on the grounds that the offences were serious in nature and he had committed a breach of trust.

He said the complainant and the accused worked together at the time of the alleged offences.

He also said that there were pending investigations for offences of a similar nature against the accused.

 

Vakadiwaiwai’s lawyer Tanya Waqanika told the court that the offences her client faced were on the lower spectrum of the sexual offence crimes.

Ms Waqanika said the accused had been suspended since June 14 this year and there were no possibilities of interference with witnesses as the accused was not allowed to enter the vicinity and locality of the CWM Hospital.

She added that since the previous case came to light two weeks ago, this case which was two years old had become a harassment case.

 

Bail Ruling

Magistrate Ratnayake ruled that there was nothing that suggested that releasing the accused on bail was of public interest.

He said it was highly unlikely for the accused to interfere with the witnesses as he was suspended.

He added that as per the Bail Act, the presumption of bail was in favour of the accused.

 

Bail Conditions

Vakadiwaiwai has been released on bail on the sum of a $2000 cash bond and a personal non-cash bond of $2000.

His two sureties have been ordered to sign a $2000 non-cash bail bond each.

Vakadiwaiwai is ordered not to re-offend while on bail, not to interfere with the witnesses, not to change his address, and to advise the court if there were any changes of address.

The matter will be called for mention on August 15.
