An American national, who was sentenced by the Nadi Magistrates Court in December last year, appeared in the High Court in Suva yesterday afternoon for a review of his sentence.
Sonny David Blake was fined $1000 and sentenced to 24 months imprisonment suspended for five years after pleading guilty to one count of bribery and one count of being in possession of firearms without a licence.
Justice Paul Madigan informed him that the Chief Justice, Anthony Gates, wanted the court to review Mr Blake’s sentence.
Justice Madigan said a hearing of the review was scheduled for May.
He told Blake that he had a right to have a say on the matter and be in a position to tell his side of the story.
Blake was enlightened by Justice Madigan of his rights to a lawyer and that he can make an application to the Legal Aid Commission or to instruct a private lawyer.
Blake then informed the court that he was due to fly back to the US on Monday.
Justice Madigan said that he was on the travel embargo list with the Immigration Department and was not to leave Fiji until the completion of the case.
He said he also wanted the matter to be dealt with as soon as possible so that Blake could go back to the US. The case was adjourned to 8:30am today.
