Landlords obliged to provide smoke free premises

Smokers unable to resist the urge for a few puffs on the streets will find themselves not fined as smoking on the streets is not prohibited under the Tobacco Control Decree.
The Ministry of Health’s Tobacco Control Unit officer in charge, Aminiasi Tavui, confirmed that smoking on the streets was not covered in the decree or regulation.
“Currently the streets are not yet covered in our tobacco legislation but common sense should prevail because every person has the right to breathe clean air as it is a basic human right,” Mr Tavui said.
He said it was important for smokers to be considerate of others around them, and to smoke in a place where no one would object to it or get affected. In section 43 (1) of the Tobacco Control Regulation 2012, any workplace accessible by the public, any enclosed entrance way, foyer, lobby, stairway, passageway, toilet accessible by the public, any classroom, lecture room or lecture theatre, any area of the shop or retail place accessible by the public, any eating house, any designated no smoking zone in a tavern, bar or nightclub are classified smoke-free areas.”
He said they were working with landlords in making them aware that they have an obligation to ensure that no one smokes in their premises.
“If anyone is found smoking in one of these public areas by enforcement officers, the landlord will be fined $1000 whilst the person smoking will be fined $200.”
Mr Tavui said this was to be paid within 21 days or the offender will face 20 days imprisonment.
“It’s time to finally put the harm of smoking where it belongs – on smokers,” he said.
