A 26-year-old unemployed man was yesterday sentenced to 10 years imprisonment by the High court in Suva for raping his six-year-old cousin.

The court heard that the accused had pleaded guilty to one count of rape and another count of sexual assault on August 8, 2014 and on September 12 he admitted a set of relevant facts that was put to him.

In sentencing the accused trial judge Justice Paul Madigan said he found the accused guilty of both counts and found him guilty for both counts.

Fiji-Police-emblemThe facts were that the accused and the victim live together at a temporary settlement.

The incident occurred on May 23 after the accused told the victim to go and have her bath and then go to his house which was two houses away.

The victim did that and on arriving at the house the accused committed the acts on her.

The accused then took a picture of the victim’s private part on his mobile phone; gave her some food after which she returned home.

Three days later the victim told her grandmother about what the accused had done to her.

As a result the victim’s mother winformed the Police.

In mitigation the lawyer for the accused informed the court that his client was single and has a clear record. He was educated to Year Seven and worked as a juice seller earning $70 a day which he used to support his parents and four siblings. He had also sought forgiveness from the victim’s family and co-operated with Police.

The aggravating factor for this case was the breach of trust.

Justice Madigan then sentenced the accused to 10 years for the first count of rape and is eligible for parole after eight years.

He then sentenced the accused to five years for the charge sexual assault and with accordance with the ‘one transaction’ principle the sentence will be served concurrently with the rape sentence.
