A SODELPA member of Parliament is embroiled in a legal battle over a claim of $5000 made against him.

A judgment was made on September 12, 2014,  by the small claims tribunal in Nasinu for lawyer Niko Nawaikula to pay a Umesh Chand $5000.

To date no payment has been made.

When contacted yesterday, Mr Nawaikula said the order was obtained in his absence and he still wanted to fight it.

“I have made an application to set aside the order and that is with the registry. It has been with the registry for months now.”

He could not confirm when he made the application.

Documents obtained by Fiji Sun state that on  June 3 this year, the small claims tribunal awarded a judgment in favour of Mr Chand.

The tribunal ordered Mr Nawaikula to deposit with the tribunal $5000 within 21 days.

Soon after this, Mr Nawaikula made an application for a re-hearing.

On September 12, Mr Nawaikula did not turn up for the hearing and the earlier judgment was re-enforced.

Mr Chand said that as a member of parliament, Mr Nawaikula should lead by example.

The money was paid to Nawaikula Esquires as a form of deposit for a property that was being bought by Mr Chand.

That deal, however, fell through and the purchase was called off.

He said that money was paid to the firm when the family was going through some difficult times.

He is the sole earner in his family.

Mr Nawaikula maintained that the fight was still on.

Up till last Friday, Mr Chand had not received any letter from the registry advising him that Mr Nawaikula was seeking a re-hearing.
