A man was acquitted yesterday by the High Court in Suva after he was found not guilty for rape.

Justice Paul Madigan concurred with the two assessor’s opinion of not guilty and discharged Sandeep Kumar Singh. He said in his judgment that the victim’s story was incapable of belief, meaning that the complainant had every opportunity to return to her family in the West since she would go to work on her own every day.

“Her behaviour, as she describes it, does not sit well with a victim of daily rapes and assaults and for that reason I don’t believe her evidence.”

It was alleged that between October 20 and November 12, 2012 in Nasinu, Singh had carnal knowledge of the complainant without her consent.

Justice Madigan said the evidence of the complainant was of a very odd situation where she said she had agreed to share a house with the accused in return for sex. The complainant told the court that she had a very low paying job and could not afford the normal rent and so she had agreed to have shelter for sex.

However, the complainant alleged that the accused abused her and forced her to have sex with him at least once a day over a period of about six weeks.

The accused told the court that they had shared a flat and had sex which was always consensual. He said he only took a wooden knife once to quieten the victim because she was yelling for some reason.

Justice Madigan said on the day of reporting the matter of the alleged rape and assault to the Police, the complainant returned to the accused and told him she was leaving.
