Seven Years For Brothers

Two brothers were sentenced to seven years imprisonment each by the High Court in Suva yesterday for raping their nephew.

They pleaded guilty to the charges last month.

The court heard that the victim was 10 years old at the time of the first incident.

Court documents showed that the brothers were 20 and 27 respectively at the time, were single and worked as farmers.

They’ve had Year Seven education and were looking after their mother and sister.

They had confessed to the offences at the earliest opportunity and had traditionally apologised to the victim’s family.

High Court judge Justice Prabharan Kumararatnam initially sentenced the brothers to 10 years for each of the charge.

He added two years for aggravating factors and deducted five for mitigating factors.

Justice Kumararatnam, in his ruling, said the two were related to the victim and committed the offence in the same settlement which they regarded as their home.

The judge also noted that the two accused had no previous convictions.

The two will be eligible for parole after serving five years and they have 30 days to appeal.
