The Auditor-General is defending his report of 2010 in the High Court in which he made allegations against chartered accountants’ firm aliz pacific.

Peter Knight of Suva law firm Cromptons yesterday confirmed to the Fiji Sun that “defence has been filed in court”.

Mr Knight said all documents in relation to their defence was filed last week with the High Court registry.

He said now it was for the plaintiffs to start with their proceedings.

On November 28, 2014, a writ of summons was filed by Devanesh Sharma of R Patel Lawyers on behalf of aliz pacific and its managing partner Nur Bano Ali.

The defendants named in the writ of summons are the Auditor-General (Tevita Bolanavanua) and the Attorney-General Aiyaz Sayed-Khaiyum.

The writ of summons stemmed from certain “findings” of the Auditor-General which he published in the 2010 report and tabled in Parliament.

aliz pacific raised a number of issues about the Auditor-General’s report, more specifically stating that the report of 2010 stated that the then Rewa Cooperative Dairy Company Limited was informed by a representative that her firm had been appointed to implement restructure of the company.

aliz pacific is seeking re-dress and damages from the Auditor-General for public dissemination of “false information” about their office thereby causing the “enormous reputational damages”.

Through the writ of summons, they were seeking an injunction restraining the Auditor-General or his agents from further publishing any reports affecting aliz pacific and Ms Ali and an order that Auditor-General remove and or expunge those parts of the 2010 audit reports that refer to the plaintiffs.

Plaintiffs’ lawyer Mr Sharma was out of the country for the weekend and is expected back in the country today.
