Man Convicted Of Murder Awaits Sentencing

A man convicted of knifing his estranged wife and murdering another man awaits his fate after his sentencing was deferred by the High Court in Suva yesterday.

Joeli Masicola was found guilty by the court on all three counts last month being murder, attempted murder and acting with intent to cause grievous bodily harm to the victims.

On Febraury 20, 2014, the accused knifed his wife and another man, Jone Nabiasila, in Kilikali Settlement in Nepani in the early hours of the morning.

The court heard that Masicola walked from Sakoca Settlement in Tacirua to Kilikali Settlement in Nepani with the intention of killing his wife.

The 38-year-old admitted striking his wife twice and Mr Nabiasila four times causing his death.

After the incident he surrendered himself to Police .

He informed them (Police)  that he was provoked because his wife was having an extra-marital affair.

Last month, the court heard that Masicola had spoken to his wife on the day of the incident over the phone.

She told Masicola that she was in bed with another man and they were having sex.

Masicola said he could hear her moans and groans in the background during the phone conversation.

His lawyer asked the court for leniency and to consider the issue of provocation when dealing with the counts of murder particularly attempted murder.

However, Justice Temo had said this was not possible on the basis that provocation could only be used as a defence to murder and not attempted murder.

Justice Temo further argued that Masicola had had more than enough time to control his temper.

The case has been adjourned to June 5 for sentencing.
