The Office of the Prime Minister has made several recommendations for laws regarding the national flag and coat of arms.

The recommendations were made yesterday to the Parliamentary Standing Committee on Justice, Law and Human Rights.  The committee was hearing submissions on the National Flag and the Coat of Arms yesterday.

Deputy Secretary for the Policy Division of the PM’s Office Peniana Lalabalavu identified the Bill’s inconsistency with the Constitution.

She cited Section 129 under which the Fiji Navy was not listed as part of the disciplined forces, but the Bill deemed this to be so.

“We are fully supportive of all clauses – except technicalities which we view and we might just raise it.  Bill number 4 in terms of part 1 preliminary section 2 interpretation – the use of Fiji Navy is just not aligned to the Constitution (Section 129), given that Fiji Navy is not included in the disciplined forces. So maybe it might have some contextualisation to that in terms of the Bill, but that is an issue we have just identified in terms of its consistency with section 129 of the Constitution,” she told the committee.

Mrs Lalabalavu said there was a need for the inclusion of the use of electronic mechanisms as discussed in Part 3 of Section 8 on prohibitions on the use of the flag.
