Opposition parliamentarian Mikaele Leawere will remain a member of the august house after the High Court yesterday rejected a challenge against his appointment.

High Court judge Justice David Alfred dismissed the petition submitted by the Attorney-General’s Office during his judgment.

The A-G’s office had challenged the Electoral Commission’s appointment of Mr Leawere from the Social Democratic Liberal Party (SODELPA) to Parliament following the death of his predecessor Ratu Viliame Tagivetaua on May 5.

Leader of the Opposition Ro Temumu Kepa and other SODELPA supporters attended the judgment hearing to show their support.

Justice Alfred found no fault in the Electoral Commision awarding the seat to Mr Leawere as there was no evidence that he held public position during his nomination, before dismissing the petition.

Mr Leawere said:.

“I’m thankful to God for what happened today because it was through him I got my seat back and I’m looking forward to it,” he said.

Meanwhile, Electoral Commision chairman Chen Bunn Young said the hearing was never about who was going to win but clarification for all parties concerned with the matter.

“We are grateful that the clarification came in the form of a judgment, and it has given constitutional lawyers substance to now have some reference point when they advise on applications of different provisions so really at the end of the day we are all winners,” he said.

Mr Leawere, a former senior executive with the Fijian Teachers Association, will resume his seat during the next Parliament sitting in July.
