Digicel Appeal Disallowed

Digicel Fiji has been ordered by the Fiji Court of Appeal to pay costs of $4000 to Fiji Rugby Union and Vodafone Fiji.

This was after the Appeals Court disallowed Digicel’s appeal in relation to the earlier High Court ruling in favour of FRU and Vodafone Fiji.

Last year Digicel took the FRU and Vodafone to court on sponsorship issues but the High Court ruled in favour of FRU and Vodafone.

On April 1, 2014, Digicel appealed against the High Court’s ruling setting out grounds that the discretion by the learned High Court judge was wrongly exercised, the damages were not an adequate remedy, the balance of convenience favoured the appellant and status quo favoured the appellant and not the respondent.

Digicel, in its appeal, sought orders that the FRU be restrained from further performing, implementing, announcing, displaying, advertising (including but not limited to allowing Fijian 7s players to appear in commercials, advertisements or on billboards) amending, varying or further concluding sponsorship agreements (including the sponsorship agreement concluded between FRU and Vodafone on or about February 2 last year) with any of the parties of the Vodafone consortium.

They also wanted FRU to be restrained from using the logos of any Vodafone Fiji-led consortium on the Fijian 7s team’s jerseys or any other gear or clothing.

After going through written submissions from all the sides, the three Judges of the Fiji Court of Appeal dismissed Digicel Fiji’s appeal.
