Ratu Naiqama Lalabalavu lawyers file papers to challenge suspension.

Lawyers for suspended Opposition parliamentarian Ratu Naiqama Lalabalavu yesterday filed a High Court constitutional challenge against Parliament and the Speaker Dr Jiko Luveni.

Solicitors Toganivalu and Valenitabua filed the challenge seeking declarations and orders inter alia that: –

  1. Parliament and the Speaker acted outside their respective legal powers in citing and suspending Ratu Naiqama Lalabalavu for contempt.
  2. That Ratu Naiqama’s suspension cease forthwith with immediate effect.

Ratu Naiqama was suspended from Parliament after being found guilty of contempt for using a slur against Speaker Dr Jiko Luveni at a SODELPA constituency meeting in May.

His case was referred to the Parliamentary Privileges Committee and then the issue of suspension was put to Parliament for a vote, that voted in the affirmative.

In a brief statement, Opposition Leader Ro Teimumu Kepa said that Ratu Naiqama was exercising his right to seek redress on his 2 year expulsion from Parliament in May, which they                 believed was excessive and inconsistent with the provisions of the Constitution.

The statement said it was also an abuse of powers by the Speaker and the Attorney-­-General and an infringement on Ratu Naiqama’s constitutional rights.
