The trial-within-a-trial for parliamentarian Mosese Bulitavu and Jagath Karunaratne has been adjourned to September 21.

The two were charged for seditious offenses and appeared before Magistrate Usaia Ratuvili at the magistrates court in Suva yesterday.  The trial-within-a-trial or voire dire is a legal procedure used to challenge the admissibility of evidence in a trial.

Magistrate Ratuvili adjourned the case to the above mentioned date whereby the two accused would be challenging the information from their caution interview.

Bulitavu and Karunaratne were charged alongside three other accused. However, during the bail variation hearing of Bulitavu last Monday, the state applied to withdraw charges against Waisale Daganayasi, Usaia Koroi and Eroni Takape. The three were discharged after the court granted the application.

It is alleged that between August 21 and 27, 2011, Bulitavu and Karunaratne were involved in the writing of seditious comments in public places and billboards along the Suva-Nausori corridor with seditious intentions and thereby purported to bring into hatred or contempt or to excite dissatisfaction against the Fijian Government as the law established.
