Commissioner of Police Ben Groenewald last night assured the family of the victim of a fatal crash that justice will be done.

The family had demanded justice after hearing that the diplomat allegedly involved in the crash had not been arrested.

Mr Groenewald said the South African diplomat could not be detained or arrested because of diplomatic immunity. But he said the investigations would continue.

Ashneel Singh, 26, died from injuries he suffered after his car collided with an oncoming 59-year-South African diplomat’s car on Friday around 10.15pm along Edinburgh Drive in Suva.

Mr Singh’s family and relatives expressed their concerns that the diplomat was not taken into custody.

However, Mr Groenewald clarified that the diplomat had diplomatic immunity under the terms of the Vienna Convention on Diplomatic Relations 1961 under Article 29.

The diplomat was taken to hospital for the necessary prescribed medical checks and released.

“I wish to clarify and state that the diplomat is entitled to diplomatic immunity under the terms of the Vienna Convention 1961.

“Article 29 of the Eight Schedule states that a person of a diplomatic agent shall be inviolable and not be liable to any form of arrest or detention.

“The diplomat was at no stage arrested and locked in police cells.

“The investigation will continue and his immunity from the jurisdiction will be dealt with in terms of the Articles of the Vienna Convention.

“Article 29 of the convention reads ‘the person of a diplomatic agent shall be inviolable.”

“He shall not be liable to any form of arrest or detention. The receiving state shall treat him with due respect and shall take all appropriate steps to prevent any attack on his person, freedom or dignity.”

“This does not mean that the investigation will cease but there are specific restrictions in terms of the fact the he has this immunity,” he said.
