Some are confused and cannot comprehend   the Vienna Convention on Diplomatic Relations 1961 after it was used to free a South African diplomat allegedly involved in a fatal accident in Suva. They ask the question: “Does it refer to all offences?

They refer to the start of the convention which says:

“Realising that the purpose of such privilege and immunities is not to benefit the individual but to ensure the effective performance of the functions of the diplomatic mission.”

If they read Article 29 of the convention it is very clear: “The person of a diplomatic agent shall be inviolable. He shall not be liable to any form of arrest or detention. The receiving state shall treat him with due respect and shall take all appropriate steps to prevent any attack on his person, freedom and dignity.”

Only the South African government can waive this immunity. The implications? Ask the lawyers.
