Accused: I Was Forced To Urinate In Cell

Jagath Karunaratne who is charged in relation to seditious offence with SODELPA MP Mosese Bulitavu, informed the Suva Magistrates Court that he had to relieve himself inside a cellblock inside the Nabua Police Station, four years ago.

It is alleged that the two, between August 21 and 27, 2011, were involved in the writing of seditious comments in public places and billboards along the Suva-Nausori corridor with seditious intentions and thereby purported to bring into hatred or contempt or excite dissatisfaction against the Fijian Government as the law established.

Karunaratne took stand before Chief Magistrate Usaia Ratuvili and informed the Court that on October 7, 2011, at about 4pm, he was at his home in Vatuwaqa with his wife when he received a call to report to the CID Headquarters in Toorak, Suva.

Defence lawyer Amman Ravindra-Singh asked Karunaratne if he was informed of his rights which he denied.

He said he was taken to Nabua Police Station and locked in a cell. He said he called the Police officers at the Station to take him to the washroom, but nobody opened the cell.

As a result, he said, he had to urinate inside the cell. Karunaratne also informed the Court that his house and vehicle were searched by Police without a search warrant.

Police Inspector, Lemeki Mawalu, who was the witnessing officer during Bulitavu’s arrest and questioning, was asked by Bulitavu’s lawyer Barbara Malimali that her client was threatened by him or another officer.

She also put to Inspector Mawalu that her client was told to co-operate if not he would be taken to the Military camp which was denied by Inspector Mawalu.

The matter has been adjourned for November 2.
